1. About These Terms
These Terms and Conditions set out the basis on which Mongkol Law provides legal services to its clients. Mongkol Law is a legal practice registered in Thailand with its principal office at 309 Phaya Thai Road, Ratchathewi, Bangkok 10400.

2. Services We Provide
Mongkol Law provides legal services in connection with pension matters, including but not limited to pension reviews, query handling, and full representation in pension disputes or appeals. Our services are described on our website and in any engagement letter or fee proposal we provide to you.
We do not provide tax advice, investment advice, or financial planning services. If matters arising from your pension situation require expertise outside our practice, we will let you know and may suggest that you seek appropriate specialist advice.
2.1 Engagement
Our professional relationship begins when we confirm in writing that we are acting for you. We reserve the right to decline any instruction where we consider it appropriate to do so, including where a conflict of interest arises.
2.2 Scope of work
The scope of our work is defined in the engagement documentation we provide. Any significant change to the scope will be agreed with you before we proceed and may affect fees.
3. Fees and Payment
Our fees are set out in our engagement letter or fee proposal, or as displayed on our website for fixed-fee services. All fees are quoted in Thai Baht (฿) and are inclusive of any applicable taxes unless stated otherwise.
3.1 Fixed fees
Where a fixed fee is agreed, this covers the work described in the engagement documentation. It does not cover unforeseen complexities, disbursements, or work that falls outside the agreed scope.
3.2 Disbursements
Out-of-pocket expenses incurred on your behalf — such as official fees, document authentication, or courier costs — will be invoiced separately at cost. We will advise you of any anticipated disbursements before incurring them where practicable.
3.3 Payment terms
Invoices are due for payment within 14 days of issue unless otherwise agreed. We reserve the right to pause work on a matter where fees remain outstanding after that period.
3.4 Refund policy
Where work has commenced and fees paid in advance, refunds will be calculated by reference to the work completed at the time of termination. Fees for completed stages of work are non-refundable.
4. Your Responsibilities
In order for us to advise and represent you effectively, we ask that you:
- Provide us with complete and accurate information about your pension situation and any relevant documents
- Inform us promptly of any changes to your circumstances that may affect your matter
- Respond to our communications within a reasonable time
- Attend any meetings or appointments that are necessary for the progress of your matter
- Tell us if you have questions or concerns at any point — we welcome them
The quality of advice we can provide depends on the completeness of the information you share with us. We accept no liability for outcomes arising from information that was withheld or inaccurate.
5. Confidentiality
All information you share with us in the course of our professional relationship is treated as strictly confidential. We will not disclose your personal or matter information to third parties except:
- Where you have given us your express permission to do so
- Where it is necessary to progress your matter (e.g. correspondence with a pension authority or fund on your behalf)
- Where we are required to do so by applicable Thai law or by a court order
- Where required by our professional regulatory obligations
6. Intellectual Property
All content on this website — including text, layout, and visual elements — belongs to Mongkol Law. You may not reproduce, copy, or distribute this content for commercial purposes without our prior written permission. Documents prepared for you as part of our services remain subject to professional privilege and are provided for your personal use in connection with your matter.
7. Limitation of Liability
Our liability to you in connection with any matter is limited to direct losses arising from our professional negligence, subject to the limit set out in our engagement documentation. We are not liable for any indirect, consequential, or special losses.
Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence, or any liability that cannot be lawfully excluded under Thai law.

8. Termination
Either party may terminate the engagement by giving reasonable written notice. We reserve the right to terminate without notice in circumstances that make it professionally or legally inappropriate to continue, such as a conflict of interest, non-payment of fees, or failure to provide information we require.
On termination, we will provide you with a summary of the steps taken and the current status of your matter. Files and documents belonging to you will be returned on request once any outstanding fees have been settled.
9. Governing Law and Disputes
These terms are governed by the laws of Thailand. Any dispute arising from them or from our engagement will be referred in the first instance to our internal complaints procedure. If a matter cannot be resolved through discussion, it will be subject to the jurisdiction of the courts of Thailand.
10. Complaints
We take all complaints seriously and will address them with care. If you have a concern about our service, please raise it with us directly in the first instance. We will acknowledge your complaint within 3 working days and provide a substantive response within 21 working days.

11. Changes to These Terms
